Employment Law

Labor Law also known as employment law is the organization of laws which deals with the legal rights of and limitation on working people and their organization. It reflects various aspects of relationship between employers, employees and trade union. During 19th and 20th century, Labor Movement struggled to protect the labor rights. Prior to industrial revolution, workers were exploited at the hands of their employer. The exploitation of labor had surfaced the need of labor law governing their demands for better employment conditions.Labor law concerns itself with the inequality of bargaining power between employer and worker. Labor laws prevented the unfair utilization of labor.

Ahead of industrial revolution workers have to work for long 14-15 hours. Labor law regulating the working hours of workers helped in securing 8-9 hours of work. They were also deprived of certain benefits which they had the right to own. Labor laws on health and safety ensure workers to acquire safe and healthy work environment. Health and safety laws for workers helped in reducing occupational health hazards and promoted the welfare of workers.

Child labors were subjected to special provision due to the empowerment of labor law. Workers were guaranteed minimum wage due to the inception of labor law on minimum wage. Industrial disputes were addressed by Industrial dispute Act and thereby achieving harmonious relationship between employer-employer, employer-employee and employee-employee. The central goal of resolving disputes is to maintain amity in the industries.

Trade Union is an organization of employees who have lined together to accomplish common goals such as better working conditions and promoting employment security. Trade Union negotiates with the employer of the organization in order to achieve better terms of employment. Trade Union looks after the welfare of worker and ensures that the voice of every worker is heard. Laws made certain strikes legal which can be used as a powerful weapon for satisfying the demands of workers. The promotion of rights of labor eventually led to industrial democracy. Industrial democracy enables the labor to experience high level of satisfaction as labor is involved in decision-making. Accomplishment of labor rights is essential for the social and economic development of any nation. International Labor Organization is one of the oldest surviving organizations dealing with labor issues. This organization is persistently working for the welfare of the workers and up gradation of their standard of living. Labor laws have ensured the laborers to enjoy certain labor rights.
