Freedom of Speech

Freedom of thought means every person has the right to consider his thought, view or fact regardless of others viewpoints. Everyone has the right to freedom of thought, religion and conscience. This right consists of freedom to alter his belief or religion either alone or in society with others and in private or public, to clear his belief or religion in practice, teaching and worship. It is closely linked with freedom of expression, freedom of speech and freedom of religion. All persons have the right to hold opinion and expression (on the basis of reason, logic and science) without any interference. Everyone has right to collect and communicate information via any media.

According to Article 18 and 19 of the UDHR (Universal Declaration of Human Rights) and ICESCR (International Covenant on Economic, Social and Cultural Rights)    “Everyone has the right to the freedom of expression. It consists of freedom to hold views without obstruction and to collect and communicate ideas and information via any media and regardless of boundaries.”

“Everyone has the right to the freedom of thought, religion and conscience. It consists of freedom to change their principle or religion, and freedom, either alone or in society with others and in private or public, to prove their principal or religion in worship, observance, practice and teaching.”

It is a fundamental right to be enjoyed by all people regardless of religion, political information, social origin, culture, age, gender or any other conditions. Freedom of Expression is a cornerstone of any democratic country. It has the significant role in democracy and public involvement in political life, because open thoughts of applicants are important for voters to make well-versed decisions during elections. Freedom of expression is integral to tolerance, which some people feel should be a basic value in society.

The media has a vital role in evaluating and analyzing the actions of government, forcing them to set policies and manage resources in an impartial and transparent way. The freedom to convey information can come under attack in a variety of ways and particularly flout on the freedom of the media. Governments have a duty to abolish obstacles to freedom of thought and expression, and to create the atmosphere in which free media and free speech flourish. Media professionals should be able to work freely without fear of terrorization, hostility and detention.

These rights can only be restricted in certain circumstances, to protect the reputation and rights of others.

These rights can be restricted only when:

  • Expression was made with the intention of causing violence, unlawful action, or harm.
  • To limit the spread of harmful, child pornography or illegal content via internet, satellite and digital broadcasting.
  • To protect national security, public health or morals.
