The attack on Iraq in 2003, created a question whether the attack was a justified war. People who were mutual in the discussion outlined their point of view as a justified war. Supporters of the attack or war inclined to believe that United States as a powerful nation possess the justifiable and rightful authority. Antagonist of the war emphasized that the United States had neither terminated its tactful decision nor permitted international efforts to succeed.
The Iraq war was regarded as an unjust war by Pope John Paul II. Baltasar Gazzon, one of Spain’s outstanding judges on terrorism –linked cases and war crimes had termed the US –led assault of Iraq amongst “the most unjustifiable and disgusting incident in current human history.” The judge also criticized the President of US George Bush including Spanish and British Prime Ministers Jose Maria Aznar and Tony Blair, who strongly supported the invasion “in spite of having biased information and doubts”.
Furthermore, an army major in a German court has argued that the US did not legally attack Iraq; therefore he ruined no laws in denying obeying a military order. The author finally concluded that such decisions set an example for the identification of the Iraq war as an act of violence, and therefore a war crime- of which the government of British should be cautious.
A prosecutor of Nazi battle crimes believes the Iraq war to be the most “supreme universal crime” and deserves imprisonment in an international court. The UN Charter clearly states that no nation can utilize armed force without the permission of UN Security Council. Ferenccz argues that George Bush along with Saddam Hussein should face allegations for war crimes.
During the Security Council’s discussion on the situation in Iraq, a group of NGOs has written the Council to raise their voice regarding the adverse situation in Iraq. Many reports were released by human rights organization and United Nations Assistance Mission for Iraq (UNAMI). These reports have emphasized vital violations of universal human rights; especially in the area of imprisonment practices. The former human rights Chief John Pace of UNAMI hold military operations of US and illegal attack on Iraq responsible for the destruction and instability of Iraq. He also added that US detentions were unjustified and violated the Geneva Convention.
Many NGOs pointed out that the US –led Multinational Force (MNF) in Iraq has severely violated international law such as illegal imprisonment, use of harmful or injurious weapons etc. The Multinational Force was responsible for not succeeding in reducing corruption and negligence in Iraq’s development fund. Later Amnesty International USA asked the Iraqi government to take legal actions against any crime committed in Iraq. Even though, the US and Iraqi government have succeeded in providing justice to few civilians and soldiers; there are still many crimes committed by US military forces which have not attained justice. Finally it depends on Iraqi and US governments how they will be able to apply their humanitarian laws regarding the crimes committed since Iraq war 2003 to until now.
